Privacy Collection Notification Statement - Use of CargoMax Platform

In this notice, the expressions CargoMax, we, us and our refer to CargoMax Pty Ltd ABN 93 626 171 051.

This notice applies to users that reside in Australia and our management of those users’ personal information. We are committed to protecting the privacy of individuals within Australia and their personal information (as defined in the Privacy Act 1988 (Cth) (Privacy Act)).

Please read this notice carefully as it will have important consequences for you in relation to the collection, use and disclosure of your personal information provided to us.

  1. CargoMax is the entity collecting your personal information. You can contact us by email at info@cargomax.pro, or alternatively you can write to us at U11/5 Frost Drive, Mayfield West NSW 2304 Australia.

  2. We will collect your personal information directly from you (including any unsolicited information) you may provide. In certain circumstances, we may be required to collect your personal information from third parties (including from content provided by other users of the “CargoMax” software (the Platform)).

  3. We collect your personal information for the primary purpose of enabling you to register to, and use the Platform and access any products or services available through that platform. Further to this purpose, we may collect and use your personal information to:

    (a) request or follow up any late payment of your subscription fees;

    (b) respond to your requests and inquiries;

    (c) improve the functionalities and features within the Platform; and

    (d) to optimise device compatibility and security of the Platform.

  4. We may also collect your personal information to:

    (a) send you information about products, services or events that may be of interest to you via email, post, telephone or other direct contact methods; and

    (b) conduct user surveys (such as, user satisfaction and quality assurance surveys).

  5. If we do not collect your personal information in connection with the purposes outlined in paragraph 3, you may be unable to use the Platform or be restricted from using certain features of the Platform.

  6. We may disclose your personal information to other users of the Platform, related entities, third party service providers, and other organisations set out in our Privacy Policy, for the purposes described in paragraphs 3 and 4.

  7. We may disclose your personal information to our related entities and service providers who are located in countries outside of Australia (including without limitation in Norway, Singapore, France, Germany and the Philippines) and who assist us with providing you and maintaining the Platform. However we will only do this if you consent to us sharing your personal information for use, storage and processing by those entities, by way of providing your personal information to us or by registering or using the Platform.
    If you provide us with this consent, you understand and acknowledge that:

    (a) Australian Privacy Principle 8.1 does not apply to our disclosure of your personal information; and

    (b) countries outside of Australia do not always have the same privacy protection obligations as Australia in relation to personal information, and you may not be able to seek redress in an overseas jurisdiction. Additionally the overseas recipient is subject to foreign law that could compel the disclosure of Personal Information to a third party, such as an overseas authority. However, we take reasonable steps to ensure that any third parties based outside Australia to whom we disclose or share your personal information, uses and holds your personal information in a secure manner.

  8. Our Privacy Policy sets out how you can access and correct any of your personal information collected under this notice as well as to how you can make a complaint if we have breached the Privacy Act in the handling of your personal information. By creating an account on the Platform, you indicate that you: have read this notice; acknowledge that your personal information will be collected, used and disclosed in accordance with this notice and as otherwise detailed in our Privacy Policy, to the extent it is necessary; and give your voluntary express consent to us collecting, using, storing, disclosing and disposing of your personal information in this manner.
